Rule-Making Updates in the MTCA Cleanup
The Washington Department of Ecology is reviewing and updating the Model Toxics Control Act cleanup regulation. Ecology is considering a number of policy, technical, and scientific issues as part of this rule making effort. Periodic rule review makes sure that cleanup requirements reflect current science and include new statutory requirements. Over the past decade, changes have emerged in the body of scientific information that shapes cleanup standards. Ecology is considering updates so that cleanup decisions continue to be based on the best available science. In addition, certain parts of the regulation need updating to reflect new state and federal laws. Ecology has several advisory groups participating in the process, and is interested in providing information to interested persons regarding opportunities to provide input and feedback on rulemaking topics. This discussion will provide an overview of both the issues and processes being addressed as part of this rule making effort, and will touch on some of the policy questions Ecology is facing.

Ms. Hankins joined the
Washington State Department of Ecology in 2007 as a policy analyst. She
currently supervises the Toxics Cleanup Program's Policy and Technical Support
Unit. Her division is responsible for developing statewide rules, guidance, and
policies related to the cleanup of hazardous waste sites, including developing
strategies for addressing Brownfields. A writer by profession and a scientist
by training, Martha contributed to recent and ongoing efforts in producing vapor
intrusion guidance used in Washington State.
